Senator Malone’s Legislation Protecting Minors from Sexually Explicit Fake AI Progressing through the Judiciary Committee

HARRISBURG, PAOctober 28, 2025 − Today, the Judiciary Committee introduced State Senator James Andrew Malone’s legislation to protect minors from sexually explicit AI fakes as an amendment to State Senator Tracy Pennycuick’s legislation to address AI-generated child sexual abuse material (SB1050). Like Senator Malone starting accounthis amendment would require all mandated reporters, such as school staff, to immediately report to appropriate authorities when children share intimate or sexually explicit images of other children, including sexually oriented AI fakes.

“When the opportunity arose to advance my legislation in the form of an amendment to the legislation of my Republican colleagues, I jumped at the opportunity,” said Senator Malone. “At the end of the day, I am here to get things done and protect our children. I owe it to them and to the families in my district who have been impacted by the tragic incident at Lancaster Country Day School. I am grateful to Senator Pennycuick and the Judiciary Committee for their efforts on this issue and for working with me to fill this reporting gap.”

In 2023, 48 students at Lancaster Country Day School and 12 other girls have been victims of false sexually explicit images generated by two male students using artificial intelligence. School officials were informed of the abuse but failed to report it to the appropriate authorities for several months, revealing a critical loophole in Title 23, Pennsylvania’s mandatory reporting law.

Under Pennsylvania’s Title 23, all school employees are required to report child abuse. However, children sharing sexually explicit material about other children, such as sexually explicit AI fakes, do not currently fall under the statutory definition of harassment.

In response to requests from victims and their families, Senator Malone presented legislation protect minors from sexually explicit artificial intelligence tricks by requiring mandated reporters, such as school staff, to report all instances of minors sharing sexually explicit material with other minors. The bill would protect children by amending the child-to-child contact section of Title 23 (Section 6304) to include the unlawful distribution of intimate images and sexual exploitation of children, such as the utilize of sexually explicit AI falsehoods involving minors.

Now, Senator Malone’s reporting amendment will go to the Senate as part of SB 1050, which was reported unanimously, as amended, by the Senate Judiciary Committee.
